Petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue a writ of mandamus or direction to the respondent authorities to release the pending dues, including full salary and allowances, for the suspension period from February -2023 to February – 2024, along with interest at an appropriate rate for the delay in payment. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to make the payment within a stipulated time frame as deemed fit by this Hon’ble Court. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief(s) that this Hon’ble Court may deem just and proper in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that initially petitioner was suspended vide order dated 09.02.2023 by District Education Officer, Janjgir. The order of suspension was put to challenge by filing a writ petition bearing WPS No. 5832 of 2023 which was disposed of vide order dated 02.11.2023 directing respondents therein to consider the claim of petitioner based upon which suspension of petitioner was revoked and he was reinstated vide order dated 18.01.2024. He further submits that in order dated 19.02.2024 vide Annexure P-5 it was observed that the two increments withheld with cumulative effect are being restored and petitioner posting will remain at the Govt. Primary School, Budhna, as per previous orders. The case will be decided on merits, after conclusion of departmental inquiry. However, decision has not been taken against which petitioner has submitted representation before respondent no. 3, 4 and 5, which is pending consideration. 3 / 3 Therefore, direction be issued to respondent no. 3, 4 and 5 to consider and take decision on pending representation at the earliest, within stipulated time period. 3. Learned counsel for State submits that according to his instructions, the decision on the period of suspension vide order dated 28.08.2025 wherein it is decided that the period of suspension of petitioner is to be treated as period in service and, therefore, nothing remains for adjudication in this case, because relief sought for has been granted by respondent authorities. 4. On due consideration of submission made by learned counsel for respective parties and further considering the nature of relief as sought for, I find it appropriate to dispose of this writ petition at this stage directing respondents to decide the claim of petitioner based on the representation submitted by petitioner with regard to pay, allowances of petitioner during the suspension period, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of the Order. 5.
