This petition has been preferred by the petitioners under Article 226/227 of the Constitution of India, seeking following reliefs:- “10.1 That the Hon’ble Court may kindly be pleased to direct the Additional Sessions Judge, Katghora, District Korba to conclude the proceeding of unregistered case filed under Section 144 of the Chhattisgarh Palika Parishad Adhiniyam by the petitioner as early as possible within stipulated time. 10.2 That the Hon’ble Court may kindly be pleased to call the entire record pertaining to the election of ward member held in the Ward No.10 of Bankimongra, District Korba (C.G.) 10.3 Any other relief which may deem fit and proper in the circumstances of the case, in the interest of justice.” 3. Learned counsel for the petitioner submits that an application filed under Section 144 of the Chhattisgarh Nagar Palika Parishad Adhiniyam, 1961 was filed by the petitioner before the learned Additional District Judge, Katghora, District Korba (C.G.), the said application is still unregistered. He further submits that application was filed seeking reliefs that the election of the Ward Corporator in Ward No.10, the nomination of respondent No.5/Pramod Sona in Municipal Council Bankimongra, District Korba (C.G.) be declared as null and void. He further submits that the application was filed on 15.05.2025 and till date it has not been decided. Thus, the learned Additional District Judge, Katghora, District Korba (C.G.) may be directed to decide the same within the time frame. 4. Learned counsel appearing for the respective respondents opposes the submission made by the counsel for the petitioner. 3 5. I have heard learned counsel for the parties and perused the material available on record. 6. From perusal of the order sheets, it appears that the said application was filed on 15.05.2025. Further, it indicates that an application under Order 1 Rule 10 of CPC along with application under Order 6 Rule 17 of CPC have been filed by the petitioner. Thereafter, notices were issued to the proposed parties and the matter is pending from couple of days. Thereafter, it appears that the notice issued to the defendant No.2 was not returned served or unserved. Again notice was issued by the ordinary as well as speed post to the defendant No.2. Order sheet also indicates that petitioner has failed to pay the process fee in compliance of the Court’s order. Again the notice was issued to the defendant No.2 and on many occasions, the case was pending for issuance of notice. Thus, in view of above, this Court is of the opinion that no time bound direction is issued to learned Additional District Judge, Katghora, District Korba (C.G.) for deciding the case. 7.
