:
1. Heard Mr. Joshi, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent. 2. This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking bail in connection with C.R. No.20 of 2022 registered with Lonikand Police Station for offences punishable under Sections 302, 307, 341, 143, 147, 148, 149, 427, 120(3) and 201 of the Indian Penal Code, 1860; Sections 3 and 7 of the Criminal Law Amendment Act; Sections 3(25) and 4(25) of the Arms, 1959; Sections 37(1), 3 red with 135 of the Maharashtra Police Act, 1951 and under Sections 3(1)(1), 3(2), 3(3), 3(4) of the Maharashtra Control of Organised Crime Act, 1999. 1 of 4

3. Applicant is one of the co-accused persons. Out of 24 accused persons in the present case, 13 co-accused persons have already been enlarged on bail. Applicant is arrested on 30.08.2022 and has completed 4 years 2 months in incarceration pending trial. That in itself persuades the Court to consider the case of Applicant for grant of bail on the ground of long incarceration itself. Charge is framed, but the trial has not commenced and the ignominy of the trial not even commencing and for that matter not concluding in the near foreseeable future being prima facie evident enables me to consider present Application. 4. The role of present Applicant as seen from the prosecution case is also identical to other co-accused persons. Intriguingly, the gang leader in the present case has been released on bail by the Supreme Court, which fact has been observed by this Court while passing order for grant of bail to one of the co-accused persons on 29.09.2026 in Bail Application No.3642 of 2026. In that view of the matter, I am inclined to consider the case of Applicant for grant of bail. 5.
Hence, in view of above prima facie observations and findings, Bail Application of Applicant is allowed subject to the following terms and conditions:- (i) Applicant – Mauli @ Ketan Ramdas Kolte is directed to be immediately released from prison in connection with 2 of 4
62.BA.1390.2026.doc CR. No.20 of 2022; (ii) Applicant is directed to be released on bail on furnishing P.R. Bond of Rs.50,000/- (Rs. Fifty Thousand only) with one or two sureties in the like amount; (iii) Applicant shall report to the Investigating Officer at Lonikand Police Station, once every month, on the first Monday of the month between 10:00 a.m. to 12:00 p.m. until commencement of trial and thereafter shall attend all dates of hearing before the Trial Court; (iv) Applicant shall cooperate with the conduct of the trial and remain present before the Trial Court on all dates, unless specifically exempted. Applicant shall not seek unnecessary adjournments. Any such conduct shall entitle the prosecution to apply for cancellation of bail; (v) Applicant shall not leave the State of Maharashtra without prior permission of the Trial Court; (vi) Applicant shall not influence any of the witnesses or tamper with the evidence in any manner; (vii) Applicant shall keep the Investigating Officer informed of his current residential address and mobile telephone number and shall forthwith inform the Investigating 3 of 4
62.BA.1390.2026.doc Officer of any change in his residential address or mobile telephone number, as and when such change occurs; and (viii)Any breach or infraction of any of the aforesaid conditions shall entail cancellation of the bail granted to the Applicant. 6. It is clarified that the observations made in this order are limited for the purpose of granting bail only and I have not made any observations on merits of the case. The trial shall be adjudicated on the strength of the evidence led and strictly on its own merits being uninfluenced with any of the prima facie observations made hereinabove in this order. 7.
Bail Application is allowed and disposed in the above terms. [ MILIND N. JADHAV, J. ] Ajay 4 of 4 AJAY TRAMBAK UGALMUGALE Digitally signed by AJAY TRAMBAK UGALMUGALE Date: 2026.10.12 20:19:14 +0530
