1. Petitioners herein seek quashing of FIR No. 0481/2025 dated 27.11.2025, registered at Police Station Jamia Nagar, for commission of offences under Sections 85/316(2)/89/115(2)/3(5) of Bharatiya Nyaya Sanhita, 2013 (corresponding Section 498-A/406/313/323/34 IPC), along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The marriage between complainant (respondent No.2 herein) and petitioner No.1 was solemnized on 28.12.2024, as per Muslim rites and customs. However, on account of temperamental differences, the parties started residing separately and when a complaint was lodged by respondent No. 2, it resulted into registration of the abovesaid FIR. 4. Charge-sheet has already been filed, albeit, charges are yet to be framed. 5. Fortunately, matter has been amicably settled. Copy of Settlement Deed/Compromise Deed dated 26.02.2026 has been placed which records that with the intervention of respectable persons, elders of the family and well-wishers, parties have been able to resolve their all disputes and differences and have started residing together and their present matrimonial life is peaceful and cordial. 6. It is in the abovesaid backdrop that quashing is being sought. 7. Respondent no. 2 is present in-person and she has been duly identified by her counsel as well as by Investigating Officer. 8. When asked, respondent No.2 reiterated the terms of abovesaid settlement and states that she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever. She submits that she has resumed matrimonial ties with her husband after burying the hatchet and is, presently, living with her husband for last four years and would have no objection if the present FIR is quashed. 9. In Narinder Singh & Ors.
vs. State of Punjab & Anr., (2014) 6 SCC 466, the Apex Court observed that proceedings, even in non-compoundable cases, can be quashed on the basis of settlement provided that the Court is satisfied that there was no meaningful purpose in continuing with the proceedings, and that the scope of conviction was remote and bleak. SCC 303. 10. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 11. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 12. Consequently, to secure the ends of justice, FIR No. 0481/2025 dated 27.11.2025, registered at Police Station Jamia Nagar, for commission of offences under Sections 85/316(2)/89/115(2)/3(5) of Bharatiya Nyaya Sanhita, 2013 (corresponding Section 498-A/406/313/323/34 IPC), along with all consequential proceedings arising therefrom, is, hereby, quashed. 13. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record. 14. The petition stands disposed of in aforesaid terms. 15. Other pending application also stands disposed of in aforesaid terms.
