THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 4771/2026
ORDER:
This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“ to Issue writ or order or direction particularly in the nature of writ of MANDAMUS by declaring the action of the respondents in not considering the Petitioners explanation along with all evidences submit by the Petitioners as a President and General Secretary of the Petitioner Association dated 08.02.2026 and not enter the Petitioners Association in proceedings of Electoral College List dated 10.02.2026 without Petitioner Association representatives (Andhra Pradesh State) for conducting elections of the 3rd Respondent dated 22.02.2026 as illegal, arbitrary, unjust and unconstitutional and violation of Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the Respondent No.3 to enter the Petitioners name in Electoral College List of the 3rd Respondent for utilising their voting rights as an authorised representatives of the Petitioner Association in the interest of justice and for such other orders that may be deems fit and proper in the circumstances of the case and pass such other order.”
2. Heard the learned counsel for the petitioners. 3. Learned counsel for the petitioners submits that respondent No.3 association is conducting elections for its executive committee for a period of three years i.e., 2026-2027, 2027-2028 & 2028-2029. Accordingly as per its bylaws, election schedule was issued on 01.02.2026 and provisional voters list was published on 07.02.2026 and requested for objections from 07.02.2026 to 09.02.2026 i.e., for three days and final list was published on
10.02.2026. But, respondent No.3 did not enlist the name of the
5
petitioner-association in its final list. She further submits that the petitioner association is the affiliated member for the State of Andhra Pradesh with the National Association i.e., 3rd respondent herein. The petitioner has been continuing as member on behalf of the State of Andhra Pradesh as State Association. But to the surprise of the petitioner, it was not find in the list of voters in the ensuing elections. Hence, the election process is liable to be interfered. 4. Heard the learned counsel for the petitioners and perused the material placed on record. It is settled law that even though the elections notified and conducting by the National Level Association by code of elections as per its bylaws, the same cannot be interfered by way of judicial review.
The said principle was enunciated time and again by the Hon’ble Apex Court, since from N.P. Ponnuswami vs. The Returning Officer, Namakhal Constituency, Namakkal, Salem District and others1, and Mohinder Singh Gill and Another Vs. The Chief Election Commissioner, New Delhi and Others2. 5. It is observed that for the reasons best known to the petitioner-association, it neither submitted any objections nor made any representation for consideration of its affiliation within the time. It seems that the petitioner-association, especially the office bearers of the petitioner-association are neither vigilant nor diligent in managing

6
the affairs of the association. It is mandatory on the part of every State association to get it affiliated with the 3rd respondent association as per the National Sports Code and by complying with the terms and conditions and as per bylaws of the 3rd respondent. As per the affiliation terms, every State Association shall pay affiliation fee for every year to respondent No.3 for getting affiliation. As per the evidence filed by the petitioner herein, the petitioner association paid affiliation fee for the year 01.04.2024 to 31.03.2025. But not filed any proof of fee paid thereafter. Admittedly the affiliation fee which was paid by the petitioner will be ended by 31.03.2026. The proposed final list for conducting elections was notified for the years 2026-2027 to 2028-2029. These things indicate that amount of negligence/irresponsibility on the part of the office bearers of the petitioner association to get affiliation they should pay required affiliation fee of Rs.10,000/-, but it appears that the same was not paid. Without paying affiliation fee by the petitioner-association, it cannot deemed for affiliation or as a member of executive council in violation to the terms of bylaws of respondent No.3.
However, since the petitioner is canvassing that the petitioner-association is an affiliated association, it should be allowed to participate in the present ongoing elections for executive committee of the respondent No.3 is not valid, untenable and unsustainable for the reason that,
7
there is no affiliation to the petitioner institution for this year 2025-
2026. 6. In view of the settled principle of law the petitioner- association is not entitled for any relief as of now to stall the election for the executive committee of the 3rd respondent. However, the petitioner is at liberty to submit a detailed representation for further
consideration to become affiliated member to respondent No.3 after complying with all the requirements as per terms of bylaws of respondent No.3. After such compliance, respondent No.3 shall consider the request of the petitioner and pass appropriate orders for granting affiliation in favour of the petitioner-association.
7. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel miscellaneous application, pending, if any, shall also stand closed.
