ORAL ORDER
1. In this petition, the petitioners are assailing the enquiry notice dated 08.04.2026 (Annexure-M) issued by the respondent no.3.

2. Heard Sri Jayakumar S Patil, learned Senior Counsel appearing on behalf of Sri. Sumanth Kumar S patil, learned counsel for the petitioners and learned AGA for the respondent nos.1 to 3.
3. Learned Senior Counsel appearing on behalf of the petitioners by referring to the order dated 31.01.2026 passed by this Court in WP No.2818 of 2026 ( Annexure-J) and the
order dated 18.03.2026 in WP.No.27774 of 2025 (Annexure K) contended that the petitioner therein i.e. Sri. Basavaraju has raised the dispute under Section 70 of the Karnataka Cooperative Societies Act, 1959 ( for short, the Act) before respondent no.3 herein and learned Senior counsel for the petitioners further contented that, in that view of the matter, the respondents have issued the impugned notice at Annexure- M. Accordingly, sought for interference of this matter.
4. Per contra, learned AGA for respondent nos.1 to 3 invited the attention of this Court to the provision under Section 30 of the Act, as well as the action taken against respondent no.4 and contented that, the cause of action for

raising the dispute by the aggrieved employee of the society has nothing to do with the Annexure- M and therefore sought for dismissal of the petition.
5. In the light of the submissions made by the learned counsel appearing for the parties, on careful examination of the
order dated 18.03.2026 (Annexure-K) in WP No.27774 of 2025, wherein the employee of respondent no.4 was directed to approach the competent authority under Section 70 of the Act and since the employee of respondent no.4 has already raised dispute under Section 70 of the Act, 1959 which requires to be adjudicated by the competent authority, I felt that the petitioners herein be permitted to file their objection to the notice dated 08.04.2026 within one week from today. Thereafter, the respondents shall take decision in the matter in accordance with law after considering the objection that may be filed by the petitioners herein.
6. Till the consideration of such objection that may be filed by the petitioners herein as stated above, I am of the view

that no precipitative action be taken against the petitioners herein.
7. With the aforesaid observation, the writ petition is
disposed of.
