Rakib (Rejected) CRM (NDPS) 658 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 1857 of 2025 dated 23.08.2025 under Sections 21(C)/27A/29 of the NDPS Act. And In the matter of : Mahibur SK & Anr. ……Petitioners. Mr. Arup Kumar Bhowmick .....for the Petitioners. Mr. Madhusudan Sur, Ld. APP Mr. Soumya Basu Roy Chowdhury ……for the State. Learned advocate appearing for the petitioners submits that the subject matter of recovery in the present case is 814 grams of brown sugar and the quantification has not been done by the chemical examiner. Petitioners are in custody for about eight months, as such they may be released on bail. Learned advocate for the State opposes the prayer for bail and produced the report of the State Forensic Science Laboratory which reflects that there are two narcotics substances involved. Having considered the ceiling limit of commercial quantity and the two contrabands were involved, I am of the view that quantification will not have any effect on the quantum seized in the present case. Accordingly, the rigor of Section 37 of the NDPS Act is attracted. Thus, CRM (NDPS) No. 658 of 2026 is dismissed. 2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
