CRL.M.C. 3004/2026 1 $~16 * IN THE HIGH COURT OF DELHI AT NEW DELHI Date of Decision: 02nd September, 2026 # CNR No. DLHC010167182026 + CRL.M.C. 3004/2026 USHA RANI & ORS. .....Petitioner Through: Mr. Kuldeep Rai, Advocate with petitioners. versus THE STATE GOVT. OF NCT OF DELHI & ANR......Respondent Through: Mr. Satinder Singh Bawa, APP with SI Shubham. Mr. Brijesh Kumar Tomar, Advocate for R-2 with R-2. CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioners herein seek quashing of FIR No. 232/2012 dated 25.07.2012, registered at Police Station Khajuri Khas for commission of offences under Sections 323/341/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The abovesaid FIR was registered on the basis of complaint lodged by Respondent No. 2 i.e. Mr. Brijesh Kumar Tomar who claimed that all accused persons, in furtherance of their common intention, had criminally trespassed inside his house situated at Dayalpur, Delhi and caused him simple injuries. 3. After comprehensive investigation, a chargesheet was filed. Charges have already been framed by the learned Trial Court on 04.06.2019. 4. Fact, however, remains that when the matter was referred to Delhi Mediation Centre, Karkardooma Courts, Delhi, the parties were able to Digitally Signed By:SONIA THAPLIYAL Signing Date:05.09.2026 12:28:15 Signature Not Verified CRL.M.C. 3004/2026 2 resolve all their disputes and differences as would be evident from the mediation proceedings dated 20.11.2025. 5. It is in the abovesaid backdrop that the present petition has been filed. 6. Respondent No.2 is present in person and is duly identified by his counsel. The Investigating Officer (I.O.) is also present and identifies him. 7. Respondent No.2 reiterates the terms of settlement and submits that he has been already duly compensated with respect to the injuries which he had received in the abovesaid incident and that a sum of Rs. 1,65,000/- has already been received by him towards full and final settlement as compensation thereof and, therefore, he would have ‘no objection’ if FIR in question is quashed. He submits that he has entered into the abovesaid settlement out of his own free will, without any coercion, force, threat and influence from any corner whatsoever. 8. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioner. 9. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 10. Consequently, to secure the ends of justice, FIR No. 232/2012 dated 25.07.2012, registered at Police Station Khajuri Khas for commission of offences under Sections 323/341/34 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed. 11. Original affidavits of the parties be submitted before the learned Trial By:SONIA THAPLIYAL Signing Date:05.09.2026 12:28:15 CRL.M.C. 3004/2026 3 Court within four weeks from today. 12. The petition stands disposed of in aforesaid terms. 13. Other pending application also stands disposed of in aforesaid terms.
