Advocate for the petitioner(s): Mr. I H Saikia Advocate for the respondent(s): Mr. B Gogoi, Addl. AG, Assam B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH ORDER 07.01.2026
Heard Mr. IH Saikia, the learned counsel appearing on behalf of the petitioner and Mr. B Gogoi, the learned Additional Advocate General, Assam, who also appears on behalf of the respondent Nos.1 to 4. 2. The petitioner herein is aggrieved by the inaction on the part of the Assam Council of Medical Registration in not reinstating the name of the petitioner in the Register of the Assam Council of Medical Registration pursuant to the expiry of 6(six) months from the order dated 12.07.2024. 3. It is the case of the petitioner herein that an order was passed on 12.07.2024, whereby the Assam Council of Medical Registration had decided to remove the name of the petitioner for a period of 6(six) months as empowered by Section 23(1) of the Assam Medical Council Act, 1999. The petitioner thereupon after the completion of the 6(six) months, which is on 11.01.2025 had requested the Registrar for reinstating the name of the petitioner so that he is in a position to carry out his profession. Verbal requests have been followed up by a representation dated 13.11.2025. However, as nothing was done, the
Page No.# 3/3 petitioner has approached this Court by filing the present writ petition. 4.
It is seen that this Court vide the order dated 01.12.2025 sought for instructions from the respondents as to why inspite of the expiry of 6(six) months, the medical license has not been restored by entering the name of the petitioner in the Register of the Assam Council of Medical Registration. In pursuance thereto an affidavit-in-opposition has been filed providing no reasons for not reinstating the name of the petitioner in the Register of the Assam Council of Medical Registration. 5. Under such circumstances, it is the opinion of this Court that the actions on the part of the respondent authorities in not reinstating the name of the petitioner in the Register of the Assam Council of Medical Registration amounts to violation of Article 19(1)(g) as well as Article 21 of the Constitution. Consequently, this Court, therefore, disposes of the instant writ petition with the following observations and directions: (i). This Court declares that the petitioner’s registration under the Assam Council of Medical Registration shall be deemed to be valid w.e.f.
12.01.2025. (ii). The Registrar, Assam Council of Medical Registration shall forthwith and not later than 10(ten) days from today reinstate the name of the petitioner in the Register of Assam Council of Medical Registration giving it effect from 12.01.2025. 6. With the above, the writ petition stands disposed of. JUDGE Comparing Assistant
