Order No.02 Dated- 19.06.2026
Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No.10075 of 2025 to its original file.
Learned counsel for the petitioner submits that B.A. No.10075 of 2025 was dismissed for non-compliance of the peremptory order of this Court dated 13.02.2026 whereby the petitioner was directed deposit Rs.2,000/- with the Jharkhand State Legal Services Authority (JHALSA) within four weeks. It is next submitted that due to miscommunication and lapse on the part of the earlier engaged counsel, the Pairvikar of the petitioner could not comply with the order dated 13.02.2026 within the stipulated time, resulting in dismissal of the same. It is then submitted that the non-compliance of the peremptory order dated 13.02.2026, passed in the said B.A. No.10075 of 2025 was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No.10075 of 2025 and unless B.A. No.10075 of 2025 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No.10075 of 2025 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner, B.A. No.10075 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
List B.A. No.10075 of 2025 under the appropriate heading after a week.
