This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Abdul Munim, praying for grant of bail in connection with Sessions Case No.204/2025 under Sections 103(1) of the BNS Act pending before the court of learned Additional Sessions Judge, Sribhumi, Karimganj. 3. The FIR was lodged by one Champa Begum on 30.04.2025 whereupon Karimganj PS Case No. 205/2025 was registered and after investigation, charge- sheet was filed which resulted in registration of the aforesaid Sessions case. 4. Scanned record has been received. 5. It is submitted by the learned counsel for the petitioner that charge has been framed and the witnesses examined during investigation have not implicated the petitioner. The accused was arrested in this case on 15.07.2025. 6. The prosecution has not disputed the same and submits fairly that there is no direct implication in the statements of the witnesses and also submits that there are no eye witnesses to the occurrence. It is submitted by the prosecution that the statement of the accused himself is self incriminating. The prosecution objects in granting bail at this stage. 7. I have given my consideration to the matter. Keeping in mind the fact that there is not much implication in the statements of the witnesses and also the fact that the accused has been in custody since 15.07.2025 and trial is poised to began. Therefore, it may be fair to grant bail at this stage. 8. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: Page No.# 3/3 (a) shall be available during the trial. (b) Shall not hamper or tamper with the evidence (c) shall not try to influence or intimate or harm the informant or witnesses. 9. Violation of any of the conditions entails cancellation of bail. 10. Accordingly, this bail application stands allowed and disposed of. 11. Nothing stated here in this bail order shall be taken as expressing any view on the merits of the case in trial to the prejudice of either the defence or the prosecution. JUDGE Comparing Assistant
