The applicant who is in custody since 21.10.2025 has renewed the prayer for grant of regular bail in connection with Ranka P.S. Case No.124 of 2025, for the offence under Sections 317(5), 61(2) of B.N.S., 2023 and Sections 8(c) and 21(c) of the N.D.P.S. Act and Sections 18(c), 27(b)(ii), 27(d) of the Drugs and Cosmetics Act, pending in the court of learned Principal District and Sessions Judge, Garhwa. 2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. It appears that commercial quantity of prohibited drugs has been recovered from the house of this applicant and earlier the bail application of this applicant was dismissed as withdrawn vide order dated 12.03.2026 passed in B.A. No.1640 of 2026. 4. Innocence has been claimed and undertaking has been given for participating in the trial. It has been submitted by the learned counsel for the applicant that the drugs has been recovered from his house but it has been planted and he has been wrongly implicated in this case. On that basis, prayer for bail has been made. 5. Learned Spl. P.P. has opposed the prayer for bail of the applicant and submitted that the commercial quantity of prohibited drugs has been recovered from the house and this applicant is in possession and control of that house. 6. Considering the mandate of Section 37 of the N.D.P.S. Act, I am not inclined to enlarge the applicant, at this stage. Accordingly, prayer for bail of the applicant stands rejected.
