JUSTICE ANU SIVARAMAN) We have heard the learned counsel appearing for the complainants, as well as the learned Senior Counsel appearing for the respondents/accused. 2. The Contempt of Court case is filed alleging non-compliance of the interim order dated 10.08.2022, in W.P.No.15305/2022, passed by the learned Single Judge, which is produced as Annexure-A. The interim order reads as follows: “xxx xxx Stay of dispossession of the petitioners pursuant to the Preliminary Notification dated 21.03.1977 and Final Notification dated 14.05.1980 as per Annexures-F and F1 respectively and stay of order dated 18.07.2022 produced at Annexure-K, till the next date of hearing.” - 4 - HC-KAR NC: 2026:KHC:14920-DB CCC No. 842 of 2022 3. The learned Senior Counsel appearing for the respondents / accused submits that the copy of the interim order was served on the Panel Counsel only on 25.08.2022 and that the demolition happened on 24.08.2022 before the BDA, without any knowledge of the interim order. It is further submitted that on coming to know of the interim order, all demolition activities were seized and no demolition has happened thereafter. 4. It is further submitted that by an order dated 20.03.2025, the interim order was modified restricting it to the properties shown in the schedule in the application filed by the complainants themselves. 5. It is further contended by the learned Senior Counsel appearing for the respondents / accused that no demolition whatsoever had occurred in the property shown in the schedule attached to the application filed by the complainants. - 5 - HC-KAR NC: 2026:KHC:14920-DB CCC No. 842 of 2022 6. This submission is disputed by the learned counsel appearing for the complainants. 7. Having considered the contentions advanced, we are of the opinion that the question, whether there has been a violation of the order dated 10.08.2022 also can be considered in the pending writ petition. 8. This Contempt of Court case is accordingly closed, leaving open all the contentions of the parties to be agitated in the pending writ petition. Notice, if any, issued shall stand discharged.
