Learned counsel appearing for the petitioner submits that the son of this petitioner namely Sanjesh Pandit and the victim girl were in friendship and she has gone along with the son of this petitioner on her own volition. He further submits that the said girl is now residing in child welfare centre as she has refused to go along with her mother. submits that anticipatory bail may kindly be granted.
4.
Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be the father of Sanjesh Pandit and he has used unparliamentary words against the informant.
5. Looking into the contents of the FIR it transpires that the allegation of taking the girl is there against Sanjesh Pandit, who is said to be son of this petitioner and it has been pointed out further that the girl has refused to go along with her mother and in the FIR the only allegation is made against the petitioner of using unparliamentary words, however, the allegation of taking the girl is not there against this petitioner. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge – I, Dumka in connection with Dumka (Muffasil) P.S.
