[2026:RJ-JP:12012] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 3rd Bail Application No. 1685/2026 Rakesh Singh S/o Bijendra Singh @ Bijjo Gurjar, Aged About 28 Years, R/o Laharwada, Police Station Sikri, District Deeg (Rajasthan) (At Present Confined In District Jail, Alwar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Girish Khandelwal For Respondent(s) : Mr. Jaiprakash Tiwari, PP with Mr. Gaurav Gupta, AGA HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 23/03/2026 1. The petitioner has filed this third bail application under Section 483 of BNSS in FIR No.366/2024 registered at Police Station Govindgarh, District Alwar for offence under Sections 64(1), 332(b), 351(3) of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. This is third bail application filed by the petitioner. The first bail application was rejected by this Court on 29.04.2025 with liberty to file a fresh after recording statements of the prosecutrix. Now it is contended that the statements of the proseuctrix have been recorded and from perusal of the same, it appears that petitioner and proseuctrix both are major and matter is consensual in nature. He again submits that the petitioner is behind the bars since 11.12.2024 i.e. for about one year and [2026:RJ-JP:12012] (2 of 2) [CRLMB-1685/2026] three moths, the trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Rakesh Singh S/o Bijendra Singh @ Bijjo Gurjar, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
