Petitioner has filed this writ petition seeking following reliefs: “10.1 That, this Hon'ble Court may kindly be pleased to set-aside the impugned attachment order dated 06- 11-2025 (Annexure P-1). 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to work at present place i.e. Marwahi (General) Range, Forest Division, Marwahi, District Gourela- Pendra-Marwahi (C.G.). 10.3 That, the Hon'ble Court be further pleased to grant such other relief (S) as may be deemed fit and proper in the interest of justice and fair play.” 2. Learned counsel for the petitioner submits that petitioner who is holding post of Forest Ranger and posted in Forest Division Marwahi vide order dated 06.11.2025 (Annexure P-1) has been attached to Circle Office, Bilaspur as Officer on Special Duty. He contended that according to Circular issued by the the State Govt., attachment of an employee has been deprecated. High Court in Writ Appeal No.413 of 2024 and other connected appeals (decided on 10.07.2024) had held that petitioners therein have been posted on attachment and not transfer, set aside order of posting by attachment of appellants in the above mentioned writ appeals. Case of the petitioner herein is covered with the said decision and therefore impugned order of attachment Annexure P-1 be quashed. 3. Learned counsel for the State submits that petitioner’s posting in the Bilaspur Circle Office is not an ordinary posting. Superior Officer have found prima facie involvement of petitioner in the financial 3 / 3 irregularities and the departmental enquiry is also proposed against him and therefore petitioner has been posted as Officer on Special Duty in the Circle Office, Bilaspur. 4. I have heard learned counsel for the parties and also perused the documents annexed along with writ petition. 5. By impugned order dated 06.11.2025 petitioner is posted from office of Marwahi (General) Range, Forest Division Marwahi to Circle Office Bilaspur. Order of posting of petitioner is not an ordinary order but it is shifting of petitioner to another office in exceptional circumstances where the authorities have found financial irregularities at the place and office where petitioner was posted. Order Annexure P- 1 further mentions that there is recommendation of initiating departmental enquiry and for his removal. In the aforementioned facts of case, in the opinion of this Court, decision relied upon by learned counsel for the petitioner as referred to above, is on different set of facts and is not applicable to facts of case at hand. 6. On due consideration of submissions of learned counsel for the parties, facts and circumstances of case, contents of order impugned, I am not inclined to interfere with the order dated 06.11.2025 (Annexure P-1). 7.
