The applicant who is in custody since 03.11.2024 has approached this Court for grant of regular bail in connection with S.T. No.52 of 2025 arising out of Jarmundi P.S. Case No.132 of 2024, registered for the offence under Sections 103(1)/3(5) of the B.N.S. and thereafter the charge has been framed under Sections 103(1)/3(5) & 80(2)/3(5) of the B.N.S., pending in the court of learned Additional Sessions Judge-II, Dumka. 3. Innocence has been claimed by the learned counsel for the applicant and undertaking has been given for participation in the trial. It has been submitted that there is no material against the applicant and the death has occurred due to the disease. On the above basis, prayer for bail has been made. 4. Learned counsel for the State has opposed the prayer for bail and submitted that the medical evidence suggests that the death was caused by asphyxia due to pressure on the neck and that the death is homicidal in nature. It has further been submitted that the applicant is the husband of the deceased. 5. Considering the above facts, I am not inclined to enlarge the applicant on bail.
