The petitioner has approached this Court seeking a declaration that the petitioner is entitled to placement under the Career Advancement Scheme (CAS) as an Associate Professor in Academic Level-13A with effect from 30.01.2022 having fulfilled all the prescribed eligibility conditions under the UGC Regulations, 2018. The petitioner further seeks a direction to the respondent no.3-Joint Director, Higher Education to modify and correct the date of grant of placement under the CAS of Associate Professor in Academic Level-13A as 29.01.2022 instead of 10.12.2024. 3. A perusal of the writ petition reveals that the petitioner has pointed out his eligibility for claiming such benefit before the respondent no.3-Joint Director, Higher Education, Nagpur Division, Nagpur by virtue of a detail representation dated 12.03.2026. A copy of the aforesaid representation is at Record Page No.111, Annexure-G. 4. Shri A.I. Sheikh, learned counsel for the petitioner submits that the respondent no.3 has not yet adjudicated upon the claim of the petitioner and hence, the petitioner has approached this Court. 2026:BHC-NAG:13572-DB 2 WP8121-26.odt 5. In view of above, the following order is passed:- I. The respondent no.3-Joint Director, Higher Education, Nagpur Division, Nagpur shall consider and decide the representation of the petitioner dated 12.03.2026 for grant of benefit of Career Advancement Scheme as an Associate Professor in Academic Level-13A with effect from 29.01.2022 on its own merits and in accordance with law. II. Needless to mention that the petitioner has already been granted such benefit with effect from 10.12.2024 and hence it is now only the entitlement of the petitioner from 29.01.2022 which needs to be adjudicated by the respondent no.3. III. The aforesaid decision shall be taken by the respondent no.3 within stipulated period of six weeks from the date of production of this order. IV. The petitioner undertakes to produce a copy of this order before the respondent no.3 within one week from today. V. If the petitioner is found entitled for such grant of benefit of the Career Advancement Scheme with effect from 29.01.2022, the respondent no.3 is directed to grant such benefit including the re-fixation of the petitioner’s pay in Academic Level-13A with effect from 29.01.2022 alongwith all consequential benefits within a period of three months from the date of such decision. If the order is adverse to the interest of the petitioner, the same shall be communicated to the petitioner within a period of two weeks from the date of such decision. 6.
