This petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That, the Hon’ble Court be pleased to call for entire records from the respondents for its perusal and to decide the instant writ petition. 10.2 That, the Hon’ble Court be pleased to pass an order, directing the respondents to communicate their decision on the documents executed and submitted by the petitioner as per DEEPTI JHA Digitally signed by DEEPTI JHA 2 official Letter dated 03.02.2019 (Annexure-P/9) at the earliest. 10.3 Any other order or directions deem fit and proper may also be granted in the interest of justice.” 3. At the outset, learned counsel for the petitioner submits that as per reply filed by the respondents, the matter appears to be adjudicated by the Central Administrative Tribunal, he has filed this writ petition under wrong conception, therefore, he seeks permission of this Court to withdraw this petition with liberty to file a fresh petition before the concerned CAT. He further submits that since reply and rejoinder has already been filed in this writ petition, as such the concerned tribunal may be directed to consider all these aspects, and if, possible decide the same within a stipulated period of time. 4. Learned counsel for the respondents is not having any objection. 5. Considering the aforesaid aspect of the matter and further considering the reasonable prayer made by learned counsel for the petitioner on behalf of the petitioner, the petitioner is permitted to withdraw the instant writ petition with aforesaid liberty to file a fresh petition before the concerned tribunal, while annexing all the documents and pleadings, which have been made before this Court. The concerned tribunal is directed to consider the same to be a case in which pleadings are completed and decide the same expeditiously. 6. With the aforesaid observation and direction, this writ petition stands disposed of. 7. Interlocutory application(s), pending if any, also stands disposed of.
