PATIL ORAL ORDER Writ Petition No.20494/2022 is filed challenging the order dated 12.07.2022 passed on I.A.No.VI in O.S.No.3977/2019 and Writ Petition No. 20392/2022 is filed challenging the order dated 12.07.2022 passed on I.A.No.IV in O.S.No.3977/2019 by the XV Additional City Civil and Sessions Judge, Bengaluru (CCH-3) (for short, 'Trial Court). 2. Though these petitions are listed for orders, with the consent of learned counsel for the parties, it is taken up for final disposal. 3. Heard Sri. B. S. Gurudath, learned counsel appearing for the petitioner and Sri. Satish K., learned - 4 - HC-KAR NC: 2026:KHC:22927 WP No. 20494 of 2022 C/W WP No. 20392 of 2022 counsel appearing for the respondents. Perused the materials available on record. 4. Learned counsel for the respondents at the outset submits that these writ petitions would not survive for adjudication as the suit in O.S.No.3977/2019 is decreed in view of the compromise arrived at between the parties before the Lok-Adalath. 5. It is submitted that the petitioner herein is the defendant No.1 in the suit and without the knowledge of defendant No.1, suit came to be settled between the parties and his interest in the suit remains. 6. The decree of the Trial Court placed in the aforesaid suit is perused. It is noticed that the plaintiff and defendant No.2 have settled the dispute and the suit in sofar as the petitioner is not pressed. In view of the disposal of the suit, I am of the considered view that these writ petitions would render infructuous. - 5 - HC-KAR NC: 2026:KHC:22927 WP No. 20494 of 2022 C/W WP No. 20392 of 2022 7. It is further submitted that the petitioner has assailed the compromise arrived by the plaintiff and defendant No.2 in W.P.No.2029/2026 and this Court has issued notice to the other side. Considering the said fact, I am of the considered view that these writ petitions would not survive for consideration. The petitioner to work out his remedies in the pending Writ Petitions and if he succeeds in the said Writ Petitions, it is always open for him to file a fresh Writ Petition challenging the impugned orders.
