This application is directed against the judgment dated 24.04.2026, passed by the learned Additional Sessions Judge-I cum Special Judge, Children Court, Latehar in Criminal Appeal No. 26 of 2026, whereby and whereunder, the order dated 26.03.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Misc. Criminal Application No.522 of 2026 rejecting the prayer for bail of the petitioner has been affirmed. Submission has been advanced by the learned counsel for the petitioner that the petitioner and the victim had fallen in love and subsequent thereto, physical relationship was established. It has been submitted that the victim is a major, aged 19 years and it was in fact the victim, who had enticed the petitioner. Learned counsel submits that the petitioner is in custody since 01.03.2026. Learned A.P.P. has opposed the prayer made in this application. Regard being had to the period of custody undergone by the petitioner and the fact that the victim was a major, this Court while setting aside the judgment dated 24.04.2026, passed by the learned Additional Sessions Judge-I cum Special Judge, Children Court, Latehar in Criminal Appeal No. 26 of 2026 as well as the order dated 26.03.2026, passed by the learned Principal Magistrate, Juvenile Justice Board, Latehar in connection with Misc. Criminal Application No.522 of 2026, direct that the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Latehar in connection with Manika P.S. Case No. 18 of 2026, subject to the conditions that the mother of the petitioner shall ensure the safety of the petitioner and shall further ensure that the petitioner does not come in contact with any anti-social elements.
