JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The captioned writ petition is instituted alleging high-handed and unwarranted interference by the police officials, arrayed as respondent Nos.3 and 4, in what is essentially a private civil dispute between the parties. The gist of the petitioner’s complaint is that - 4 - HC-KAR NC: 2026:KHC:18351 WP No. 9243 of 2026 the police, under the guise of exercising their authority, have exceeded their jurisdiction and have attempted to intermeddle in matters which fall squarely within the domain of the competent civil Court. 2. This Court, having taken cognizance of the serious allegations made in the writ petition, by order dated 24.03.2026, directed the learned Additional Government Advocate to secure and produce the CCTV footage of the concerned police station for the date 15.03.2026. The said direction was issued with a view to ascertain the veracity of the petitioner’s allegation that he was compelled to remain seated in the police station notwithstanding the dismissal of the civil suit instituted by the complainant. 3. In compliance with the aforesaid direction, the learned Additional Government Advocate submits - 5 - HC-KAR NC: 2026:KHC:18351 WP No. 9243 of 2026 that the CCTV footage has been secured and is made available before the Court. However, he fairly submits that the entire footage spanning the day has not yet been thoroughly examined. 4. The jurisdictional Police Officer, who is present before this Court, upon instructions, submits and assures that the petitioner shall not hereafter be summoned or subjected to any form of coercive action in relation to the subject property dispute, which is civil in nature. The said submission and assurance are placed on record. 5. Be that as it may, this Court also takes note of the fact that an NCR (Non-Cognizable Report) endorsement has been issued to the complainant, thereby appropriately relegating him to seek redressal of his grievances before the competent civil Court. In that view of the matter, and with a stern caution that - 6 - HC-KAR NC: 2026:KHC:18351 WP No. 9243 of 2026 the police authorities shall refrain from interfering in disputes of a purely civil nature, this Court deems it appropriate to dispose of the writ petition.
