…...... 03/20.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 126(2), 103(1), 303(2), 3(5) of the Bharatiya Nyaya Sanhita.
2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order.
3. Learned A.P.P. opposes the prayer for bail.
4. There is direct allegation against this petitioner which is apparent from the impugned order itself. It is this petitioner and others who assaulted the husband of the informant and committed murder. The trial is in progress and the witnesses have been examined.
5. Considering the direct allegation against this petitioner and also the fact that the twice the bail of this petitioner was rejected on 21.01.2025 passed in B.A. No.354 of 2025 and on 25.07.2025 passed in B.A. No.5679 of 2025 by co-ordinate Bench of this Court and since the trial is in progress and three witnesses have been examined, out of nine, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with S.T. Case No.320 of 2024, arising out of Radhanagar, P.S. Case No.138 of 2024, pending in the Court of learned Additional Sessions Judge-I, Rajmahal stands rejected.
6. It is expected that the Trial Court will conclude the trial within the period of seven months from the date of receipt of a copy of this
order.
