It is the case of the petitioners that they have served in the first respondent-Corporation and had retired from service on 31.05.2024 and 30.06.2024 respectively. The respondents had settled the Gratuity, Leave Salary, Provident Fund and Commutation after a delay of more than 1 ½ years. The petitioners would submit that the respondents are legally bound to pay interest to them. Therefore, the petitioners made individual representations to the respondents to pay the interest at the rate of 10% p.a., for the delay in settling the terminal benefits of them . Since there is no response, the petitioners are before this Court. 3. Heard the learned Counsel on either side and perused the materials available on records. 4. Admittedly, the Earned Leave Salary, Gratuity Amount and PF and https://www.mhc.tn.gov.in/judis WP No. 7888 of 2026 __________ Page3 of 4 Commutation Amount has been paid to the petitioners belatedly for no fault of them. Hence, the petitioners are entitled to interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount, PF and Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order.
