P BORAH,MS P DAS Advocate for the Respondent : PP, ASSAM,
BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER Date : 05.01.2026
Heard Mr. K. Boruah, learned counsel for the petitioners. Also heard Mr. Page No.# 2/4 D.P. Goswami, learned Additional Public Prosecutor for the State. 2. This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioners namely, Raja Ahmed @ Raj Ahmed and Pratap Saikia, have prayed for bail in connection with Golaghat P.S. Case No. 201/2025 under Section 61(2)/308(4)/308(5)/196(1)/351(2) of BNS, 2023. 3. The petitioners were arrested on 14.11.2025 and stated to have completed 52 days in under trial detention. 4. The case arose out of an FIR dated 20.10.2025 lodged by inspector Mintu Handique of Golaghat police station with the allegation that the members of activist of an organization namely Bir Lachit Sena have been harassing people including business persons and extorting money from them by causing threatening and instilling fear and video graphing some of the activities and sharing it on the social media. It is alleged that some of these persons have also been demanded money from truck on the highway at night. The petitioners are the office bearers of the said organization. 5. The learned counsel for the petitioners submits that the petitioners are also prosecuted in another case being Kaliabor P.S. Case No. 115/2025 in which, vide order dated 18.12.2025, this Court pleased to grant bail in BA/4007/2025. The learned counsel draws attention to length of detention and seeks bail at this stage. 6. The learned Additional Public Prosecutor for the State submits that the investigation has lent support to the allegation about the involvement of the petitioners as part of the named organization in various illegal activities

That, some witnesses have already been examined and implicated the present petitioners. 7. The case diary, as called for, has been received along with a detailed bail objection submitted by the I/O in which the I/O has strongly opposed the grant of bail. 8. Upon perusing the case diary, I find that investigation has progressed but it is not yet complete and is still going on. Objecting to the grant of bail at this stage, the I/O has contended in the bail objection that the I/O has been found the petitioners involved in extortion activities on an organized scale, including in the district of Golaghat, pertaining to the instant police case. They are also in possession of firearms which have been used to threaten the victims for the purpose of committing extortion. It is contended that the investigation has also found their involvement in extorting from trucks at night by threatening and use of firearms. It is contended by the I/O that granting on bail at this stage could prejudice the ongoing investigative efforts. 9. I perused the relevant portions of the case diary. The incriminating materials so far lend support to the allegations about the petitioners as part of the organization indulging in organized extortion activities. The statements of several witnesses implicate and lend support to the alleged offenses. In the given facts and circumstances, the contentions of the I/O cannot be brushed aside lightly. 10. Accordingly, I am of the considered opinion that it might be prudent
Page No.# 4/4 to refuse bail at this moment. Consequently, the instant bail petition stands rejected at this stage. 11. The bail petition stands disposed of accordingly. 12. Return back the case diary. JUDGE Comparing Assistant
