Petitioner has filed this writ petition seeking following reliefs:- “10.1 It is therefore prayed that this Hon’ble Court may kindly be pleased to issue an appropriate writ or order and set aside/quash the order dated 15.05.2025 (Annexure P/1). 10.2 It is therefore prayed that this Hon’ble Court may kindly be pleased to issue an appropriate writ or order and direct the respondent no. 3 to consider and decide the letter dated 19.06.2025 (Annexure P/2) sent by respondent no. 4 (Chief Medical and Health Officer) to respondent no. 3 (Divisional Joint Director) and promote the petitioner with effect from 15.05.2025 with all consequential benefits. 10.3 Any other relief which this Hon’ble Court may deem fit” 2. Learned counsel for petitioner submits that petitioner is holding the post of Assistant Grade-III and while working on the post of Assistant Grade – III he has become eligible for consideration of his candidature for promotion on the post of Assistant Grade-II. Respondent department has initiated the proceedings for promotion of eligible employees for the post of Assistant Grade-II, however, petitioner was not promoted. Aggrieved by which petitioner has submitted a representation before Chief Medical Health Officer, Korba, District – Korba (C.G.) /Respondent no. 4 which was duly forwarded by him/her to Divisional Joint Director, Health Services, Kshetriya Swathay Evam Pariwar Kalyan Prashikshan Kendra Parisar, Seepat Road, Bilaspur/ Respondent no. 3, however, till date the representation submitted to 3 / 3 Chief Medical and Health Officer, Korba has not been considered and no decision has been taken, therefore, direction be issued to respondent no. 3 to consider and take decision on pending representation/claim of petitioner which is forwarded to respondent no. 4 at the earliest, within specified time frame. 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection. 4. I have heard learned counsel for the parties and perused the documents available on record. 5. On due consideration of submission made by learned counsel for the respective parties and further considering the facts and circumstances of the case, this writ petition at this stage, is disposed of directing respondent no. 3 to consider and take decision on the claim of petitioner for promotion in the representation submitted by him to respondent no. 4 vide Annexure P-3 dated 17.06.2025 which was duly forwarded to respondent no. 3, in accordance with law, expeditiously, preferably within a further period of three months from the date of receipt of the Order. 6.
