This is an application filed under Section 483 of the BNSS, 2023, praying Page No.# 2/2 for granting bail to the accused-petitioner, namely, Mantu Kalita, in connection with Kamalpur P.S. Case No.123/2025, under Section 127(2)/117(2)/109 of BNS, 2023. The petitioner is stated to have been arrested on 13.10.2025. 3. The FIR was lodged by the victim herself on 03.10.2025. The gist of the allegation is that the accused person while coming to buy some medicine from the informant’s Ayurvedic pharmacy, suddenly attacked her and tried to assault her. 4. The prosecution submits that in the meantime investigation has been completed resulting in a charge-sheet against the petitioner. 5. Considering that aspect of the matter and length of detention, the present accused is allowed to go on bail of Rs.40,000/- with one surety of the like amount to the satisfaction of the concerned learned Court and subject to the following conditions:- (i) The accused/petitioner shall be available for the trial, if one commences. (ii) He shall not hamper or tamper with evidence. (iii) He shall not intimidate the informant and shall not try to influence the witnesses and the informant. 6. In case of violation of bail conditions, the bail would be liable to be cancelled. 7. Accordingly, this bail application stands allowed and disposed of. 8. Send back the case diary.
