2. GP FOR REVENUE p. 3 The Court made the following:
ORDER
Heard Sri B.Rama Shankar, learned counsel for the petitioner, Sri P.Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj & Rural Development for respondents 1 & 3, Sri M.Haribabu, learned standing counsel for respondents 2 & 4 and Sri Chaitanya, learned counsel representing Sri Y.Koteswara Rao, learned standing counsel for respondents 5 & 6.
2. The petitioner, a resident of Pathakopperla village, Pusapatriega Mandal, Vizianagaram District, filed the above writ petition to declare the action of the 5th respondent in rejecting the old age pension, though the petitioner is eligible, as illegal and arbitrary.
3.
Learned counsel for the petitioner would submit that the Government of Andhra Pradesh introduced YSR Pension Kanuka vide G.O.Ms.No.174, dated 13.12.2019 and thereafter NTR Bharosa old age pension of Rs.4,000/- to all the senior citizens. He would also submit that the petitioner is eligible to get the pension, and he approached the authorities; however, the old-age pension was not granted to the petitioner.
4. Sri M.Haribabu, learned standing counsel, on instructions, would fairly submit that the petitioner is eligible for pension as per G.O.Ms.No.174, dated 13.12.2019. He would further submit that the pension will be paid from April 2026 onwards. p. 4
5.
Learned counsel for the petitioner would submit that the petitioner, in fact, was granted a pension on an earlier occasion; however, the same was stopped without any notice.
6. Thus, as per the above contentions, there is no dispute that the petitioner is eligible to get the pension in terms of G.O.Ms.No.174, dated
13.12.2019. In fact, the petitioner was extended the benefit of pension vide Account No.10290185. No reasons were assigned before cancelling the pension, and in fact, the learned standing would fairly submit that the petitioner is entitled to the pension.
7. Given the facts and circumstances of the case, the Writ Petition is
disposed of at the admission stage with the consent of learned counsel on either side, directing the 5th respondent to ensure payment of pension to the petitioner from 01.04.2026 in terms of G.O.Ms.No.174, dated 13.12.2019, without fail. The arrears, as per the entitlement, shall be paid in three months. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
