Heard Mr. T.H. Hazarika, learned counsel for the petitioner. Also heard
Page No.# 2/3 Mr. T. Uddin, learned counsel for the respondent No. 2. 2. An FIR dated 14.05.2013 was lodged before the All Women Police Station, Guwahati with the allegations that, while the informant was doing some construction of her land, the petitioner herein was a neighbor, was disturbing and threatening her workers and on 14-05-2013, in the morning, he broke the windows of her house, entered her home and assaulted her son. It is alleged that he also assaulted her by hand and abused her and her daughter-in-law with slang language. On the basis of the FIR, All Women Police Station Case No. 99 of 13 was registered under Section 354/294/323/506/427/448 IPC. 3. The learned counsel for the petitioner submits that however, cognizance was taken by the court under section 323, 294, and 427 IPC and offence explained. In the meantime, the petitioner and the informant arrived at a settlement. 4. Thereafter, an agreement was entered into between the petitioner Parvez Hussain @ Sazu and Iftaqul Husain (Nanu) stated to be the son of the informant and also one of the alleged victims. A copy of the same has been annexed with the petition. As per the said settlement, both the parties have undertaken to amicably compromise the matter whereby the CR Case No. 706c/16 pending before learned JMFC, Guwahati would be withdrawn and that the petitioner and the informant shall file a joint affidavit in the present criminal petition for quashing the GR Case No. 5888/2013. 5.
My attention has been drawn to the fact that the said Rehana Hussain has also signed on the said agreement and she is respondent No. 2
Page No.# 3/3 in this petition. 6. Learned counsel entered appearance on behalf of respondent No. 2 and supports the settlement and submits that the informant has given her consent to such amicable settlement between the parties and has no objection to the prayer of the petitioner for quashing of this criminal proceeding. It is also pointed out by both the learned counsels that the petitioner and Iftakul Hussain @ Nanu stated to be the son of the informant are cousin brothers. 7. I have given my consideration to the matter and in my considered view that – it will be justified and fair to allow the prayer for quashing and no purpose will be served in continuing the proceeding. Accordingly, the entire proceedings of GR Case No. 5888/2013 (arising out All Women Police Station Case No. 99/13) stands quashed. 8. The instant criminal petition stands disposed with on the aforesaid terms. JUDGE Comparing Assistant
