SL. 13 04.02.2026 Court No.19 BP WPA 1824 of 2026 Ujjal Mahata -versus- The State of West Bengal and others Mr. Rabi Lal Maitra, Sr. Advocate Mr. Rajit Lal Maitra ..for the petitioner Mr. Soumitra Bandyopadhyay, Sr. Govt. Advocate Mr. Srinath Singha Roy ..for the State Affidavit of service filed in Court today is taken on record. The petitioner claims to be the owner of several plots of land as specifically mentioned in paragraph 2 of the writ petition situated within the jurisdiction of Sankrail Police Station. The petitioner alleges that fraudulent deeds have been prepared in respect of the aforesaid plots in question. The petitioner approached various authorities ventilating his grievances. Mr. Maitra, learned senior advocate appearing for the petitioner draws the attention of the Court to a letter dated December 30, 2025 issued by the District Magistrate, Jhargram in support of his contention that the District Magistrate is also aware of a land scam which is prevailing in the said locality. Mr. Maitra submits that though the District Magistrate has assured cooperation and necessary assistance in all matters to the petitioner but the petitioner is being threatened from various 2 quarters and the petitioner may be dispossessed at any point of time forcibly by unauthorised persons. The learned advocate appearing for the State files a report of the Officer in Charge, Sankrail Police Station dated 4th February, 2026. The said report specifically states that written complaint from the District Sub- Registrar, Jhargram has been received alleging that several land deeds of Bakra and Angarnali moujas have been fraudulently registered in his office during the past few months using forged and fabricated documents. The report specifically mentions the particulars of various deeds and the properties covered under the said deeds which are all situated in Bankra and Angarnali mouzas. The report further states that Sankrail Police Station Case No. 110/25 dated 16th September, 2025 has been registered under Sections 318(3)(4)/336(3)/340(2)/338/61(2) of BNS and the investigation is in progress. The report discloses that all seized electronic devices have been sent to Bidhannagar Cyber Crime Police Station for data extraction and further forensic examination at CFDEEL. The report also states that another case being Sankrail Police Station Case No. 116/25 dated 8th October, 2025 and 117/25 dated 9th October, 2025 has also been registered and in all the aforesaid three cases chargesheet has been laid with a requisition for provision of submitting supplementary chargesheet. Thus it appears that necessary steps have 3 been taken by the respondent authorities and the investigation is in progress. However, in so far as the prayer of the petitioner for declaring certain deeds to be void ab initio the remedy lies elsewhere. In case the petitioner approaches the Officer in Charge, Sankrail Police Station alleging commission of any cognizable offence, the Officer in Charge, Sankrail Police Station shall take necessary steps in that regard. The petitioner is also left free to approach the appropriate forum insofar as the declaration of certain deeds to be void ab initio is concerned. Since the authorities have already initiated a proceeding upon being informed that several land deeds have been fraudulently registered in the office of the District Sub-Registrar, Jhargram, this Court hopes and trust that necessary steps shall be taken in accordance with law. With the above observations, WPA 1824 of 2026 stands disposed of. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
