Heard learned counsel for the parties.
The petitioner named above has been made accused in connection with Bhawanathpur (Hariharpur O.P.) P.S. Case No. 134 of 2025 for the offences registered under Sections 115(2), 126(2), 64(2)(m) of the Bhartiya Nyaya Sanhita, 2023, pending in the court of Judicial Magistrate, 1st Class, Nagar Untari, Garhwa.
It is submitted by learned counsel for the petitioner that the prosecutrix is a married lady, aged 27 years and the petitioner is also a married person, aged 35 years. In view of the fact that the prosecutrix was a married lady, the allegation of consensual physical relationship on a false promise of marriage is not sustainable. Learned counsel for the State has opposed the prayer for bail.
Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
