4. We are at pains to observe that the respondent no.3, who is a competent authority to grant the ‘No Objection’ to the petitioner no.1- Management for effecting promotions to the employees, who are already appointed by following due procedure of law and when the respondent no.3 himself has accorded approval to the appointments of such employees, has caused such inordinate delay of ten years. In view of above, the petitioner no.1-Management is finding it difficult to run the petitioner no.2-College for want of sufficient staff. Even, the proposal which was submitted on 15.03.2016, is not yet decided. 5.
In view of the above, we dispose of the present writ petition with a direction to the respondent no3-Joint Director, Higher Education to decide the proposals submitted by the petitioner no.1- Management right from 15.03.2016 to 06.04.2026 on their own merit and in accordance with law within the stipulated period of four weeks from the date of this order. The decision taken on the proposals shall be communicated to the petitioners within a period of two weeks from such decision. Shri S.S. Hulke, learned Assistant Government Pleader to communicate this order to the respondent no.3-Joint Director, Higher Education, Nagpur Division, Nagpur. 6. The writ petition is disposed of in aforesaid terms. No costs. (RAJ D. WAKODE, J.) (URMILA JOSHI-PHALKE, J.) APTE Signed by: Apte Designation: Senior Pvt. Secretary Date: 09/10/2026 19:38:58
