PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2489 OF 2026 ORDER:- The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.4 for granting of pre-arrest bail in connection with Crime No.44 of 2026 of Krishnalanka Police Station, Vijayawada City, registered for the alleged offence punishable under Section 109 r/w 3(5) of BNS. 2. The case of the prosecution, in brief, is that the complainant is residing with his parents and is engaged in the rice business along with his father. The complainant stated that on 08.03.2026, at about 8:30 p.m., he, along with his friends, went to Animal Pub located in Lifestyle Mall on M.G. Road to watch the ICC T20 World Cup final match. Later, some of his friends left the place, and he, along with the remaining friends, continued watching the match. On 09.03.2026, at about 1:00 a.m., the accused, who was seated at an adjacent table, in an intoxicated condition, called the complainant and abused him, alleging that he was speaking about them. During the altercation, the accused attacked the complainant with an object, causing a bleeding injury to the left side of his head and injuries to the ring and little fingers of his right hand. 3 3. Heard Ms.S.V.Indira, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor. 4. The learned counsel for the petitioner contends that the petitioner is innocent and not committed any offence as alleged by the prosecution. He is the sole bread winner of his family. The learned counsel prays that the present petition be allowed in the interest of justice. 5. The learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioner and would submit that the Court may pass appropriate orders by giving a direction to the Investigating Officer to comply with Section 35(3) of ‘the BNS’/41-A of ‘the Cr.P.C.. 6.
