MAIMOM ANGAUTAN SINGHA R/O. VILLAGE RANIBARI, AMBIKAPATTY, SILCHAR, P.S. SILCHAR, PIN CODE 788004 DISTRICT CACHAR, ASSAM. VERSUS THE STATE OF ASSAM REPRESENTED BY PUBLIC PROSECUTOR, ASSAM. Advocate for the Petitioner : MR. P K ROYCHOUDHURY, MS. J GHOSH,MR. JUNM LASKAR Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER Date : 06.01.2026 Heard Mr. P.K. Roychoudhury, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public prosecutor for the State. 2. This petition has been filed under Section 482 of the Bharatiya Page No.# 2/3 Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Maimom Santi Kumar Singha @ M Santi Kumar Singha, has prayed for granting pre-arrest bail, apprehending arrest in connection with Sonai P.S. Case No. 61/2025 (corresponding to G.R. No. 1556/2025) under Section 319(2)/316(2)/336(2)/125/271 of BNS, 2023. 3. Vide order dated 29.10.2025, the petitioner herein was granted interim bail pursuant to which he appeared before the I/O and his statement has been recorded. 4. The case diary, as called for, has been received. 5. The case arose out of an FIR lodged by Assam Council of Medical Registration before the O/C of Sonai police station on 15-09-2025. One of the main allegations is that one person by the name Mr. U.S. Sinha is practicing as a medical practitioner at Manas Medical Hall situated at a place in the district of Cachar, projecting himself to be a doctor, though he is not a qualified doctor. It is alleged that such acts are endangering public safety and also violates the provisions of the National Medical Commission Act, 2019. 6. The present petitioner is stated to be not named in the FIR and is stated to be a PhD holder and before resigning from the job in the year 2022, he was working as registrar of the North East Council of Alternative Medicine. The learned counsel for the petitioner has drawn attention to several documents purportedly issued from the health authorities of the Government of Assam, including NRHM, regarding the North East Council of Alternative Medicine and contended in this regard that it is not a fake Page No.# 3/3 organization as alleged in the FIR. Unlike the main accused Mr. U.S. Sinha, there is no allegation against the present petitioner about misrepresenting his educational credentials. 7. Nevertheless, despite the objection of the prosecution side regarding grant of bail in the instant case, I am of the considered view that since the investigation has progressed to some extent at least and the petitioner has also appeared before the I/O pursuant to grant of interim and his statement recorded - perhaps it will not be necessary to cancel his interim. 8. Accordingly, in such view of the matter, the interring bail granted vide order dated 29-10-2025 is hereby made absolute, subject to the condition that – he shall render cooperation to the remaining investigation; shall not hamper and tamper with evidence and shall not indulge any illegal activities or offences. 9. The petition stands disposed of accordingly. 10. Send back the case diary. JUDGE Comparing Assistant
