1. Today case is listed in default for not serving the advance copy on the Respondent No. 2. 2. As learned counsel for the Respondent No. 2 has caused his presence after receiving the advance copy, default as pointed out by the Registry is overruled. 2
3. With the consent of parties, case is heard finally. 4. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. 10.2 That, this Hon’ble Court may kindly be pleased issue a writ in the nature of mandamus or any other appropriate writ, order, or direction commanding Respondent No. 2/Registrar General, High Court of Chhattisgarh, Bilaspur to decide the petitioner’s appeal dated 24.10.2024 (Annexure P/4) expeditiously, prefereably within a time-bound period of 30 days, in accordance with law and after affording the petitioner an opportunity of hearing. 10.3 That, this Hon’ble Court may kindly be pleased to decide the appeal of the petitioner and quash the order dated 05.10.2024 passed by the learned Principal District & Sessions Judge, Korba District – Korba (C.G.) and acquitted the petitioner from all the charges as no mistake has been committed by him. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief/relief’s in favour of the petitioners, which the Hon’ble Court deemed fit and just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”

Learned counsel for the petitioner submits that against the order of imposing punishment of withholding increment with cumulative effect, petitioner has preferred an appeal before the Respondent No. 2 on 24.10.2024 (Annexure P/4) and since then, it is pending and therefore, direction be issued to the Respondent No. 2 to consider and decide the appeal at the earliest within specified time frame. 6. On the other hand, learned counsel for the Respondents No. 2 & 3 would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 2 to consider and take decision on the appeal filed by the petitioner, he is having no objection to the limited prayer. 7.
I have heard learned counsel for the parties and perused the documents placed on record. 3

On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the case, this writ petition at this stage is disposed of directing the Respondent No. 2 to consider and take decision on the appeal filed by the petitioner dated 24.10.2024 (Annexure P/4) in accordance with law, expeditiously, preferably within an outer limit of 03 months from the date of receipt of
order.
9. With the aforesaid observation and direction, this writ petition stands
