In the present petition, the petitioner has challenged the communication dated 20.05.2026, whereby the petitioner has been disqualified from participating in the tender process pursuant to e-NIT dated 11.05.2026 for the auction of Adda/Entry Fee/Terminal Tax of the Municipal Council, Budgam, for the financial year 2026–27. 02. Learned counsel for the respondents, on instructions, submits that the present petition has been rendered infructuous as the contract, pursuant to the aforesaid e-NIT has already been allotted in favour of a successful bidder in terms of order No. MC/Bud/26-27/24 of 2026 dated 17.06.2026. A copy of order is taken on record. 03. In view of the aforesaid statement made by learned counsel for the respondents, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file a fresh petition, if cause survives or arises. 04.
