Heard Sri V. Venkata Mayur, learned counsel for the petitioner, Sri Rajesh Kumar, learned Assistant Government Pleader, appeared for respondents 1 & 2 and Sri Hruthik, learned counsel representing Sri M. Sudhir, learned Standing Counsel, appeared for respondent No.3. Notice of respondent No.4 is dispensed with since no adverse order is passed affecting the right and interest of respondent No.4. 2.
The grievance of the petitioner in the writ petition is that the statutory appeal filed by the petitioner on the file of respondent No.2 on 01.11.2019 (Ex.P3), has not been disposed of so far. 3. The writ petition was listed on 07.04.2026 and adjourned at the request of the learned Assistant Government Pleader to get instructions from respondent No.2. Page 3 of 4

Today, when the matter is taken up for consideration, Sri Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj, would submit that the appeal filed by the petitioner is pending on the file of the respondent No.2. He would also submit that the respondent No.2 will dispose of the appeal, as per the Rules. 5. Given the facts and circumstances of the case, keeping the writ petition pending, inviting a counter-affidavit will not serve any purpose. Hence, the Writ Petition is disposed of at the stage of admission with the consent of learned counsel appearing on either side, directing the learned respondent No.2 to dispose of the appeal filed by the petitioner on 01.11.2019 (Ex.P3), as expeditiously as possible, preferably within four (04) months from the date of receipt of a copy of this order, strictly as per the Rules, by providing an opportunity of hearing to the petitioner as well as the respondent No.3 – the private party in the appeal. The appellate authority shall ensure the issuance of notice to respondent No.3 in the appeal. No order as to costs.
