--- Respondents For Petitioners :- Mr. Ajay Shrivastava, Advocate For Respondents No. 1 - 3/State:- Mr. Sharad Mishra, P.L.
SB - Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 19.02.2026
1. By way of this writ petition, petitioners have challenged the impuged order dated 15/01/2019 (wrongly mentioned as 15/01/2018) (Annexure P/1) by which
3 petitioners’ representation has been rejected by respondent No. 2. 2. Learned counsel for the petitioners would submit that this Court, vide order dated 10/12/2018 passed in WPS/8111/2018, had directed the respondents to consider and decide petitioners’ representation with regard to regularization by scrutinizing the same on merits and passing a detailed order, however, by the impugned order, their representation has been rejected only on the ground that since petitioners are working under a Hostel run by the Tribal Department, therefore, they cannot be regularized by the respondent authorities, which is unsustainable and bad in law, as such, the impugned order is liable to be set aside. 3.
3. Learned counsel for the respondents would support the impugned order and submit that the instant writ petition is liable to be dismissed. 4. I have heard learned counsel for the parties, considered their rival submissions made herein-above and perused the record. 5. A careful perusal of the impugned order would show that it is neither a reasoned nor speaking order and the petitioners’ representation has simply been rejected
4 stating that since they are working in a Hostel run by the Tribal Department, therefore, they cannot be regularized, as such, the impugned order is hereby set aside. Matter is remitted to respondent No. 3 to consider and decide petitioners’ representation afresh as directed by this Court in WPS/8111/2018. It is made clear that this Court has not expressed any opinion on the merits of the matter. 6. Accordingly, this writ petition stands finally disposed of. No cost(s). Sd/-
