The first appellate Court dismissed the appeal and confirmed the judgment and decree passed by the trial Court. 2. Being aggrieved by the same, the appellants have preferred the present appeal, proposing the following substantial questions of law: i. Whether suit for partition without including admitted ancestral property Plot No.790 is maintainable being a case of partial partition? ii. Whether oral family arrangement requires registered document? iii. Whether decree passed after death of defendant without bringing LRs on record is nullity under Order 22 CPC? 3. Issue notice to the respondents on the above mentioned proposed substantial questions of law, returnable on 05/11/2026.
