PUBLIC PROSECUTOR The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 174/2026 ORDER: This Criminal Revision Case is filed assailing the docket order dated 09.02.2026 passed in Crl.M.P. No.85 of 2026 in S.C. No.55 of 2013 by the learned II Additional District and Sessions Judge, Krishna District at Vijayawada, whereby the petition filed by the Assistant Counsel for the prosecution seeking continuation of prosecution through the learned Special Public Prosecutor was dismissed. 2. The Sessions Case in S.C. No.55 of 2013 is pending trial and the matter is presently at the stage of cross-examination of the Investigating Officer (P.W.20). At that time, a petition was filed stating that the Special Public Prosecutor, who was appointed vide G.O.Rt.No.1066 dated 30.06.2025, was absent due to personal inconvenience, and therefore, the Director of Prosecutions, A.P Vijayawada permitted the In-charge Public Prosecutor to represent the case. Since the case is at crucial stage, change of the Prosecutor at this stage would seriously prejudice the prosecution and affect the conduct of trial. Hence, the present petition was filed seeking continuation of prosecution through the learned Special Public Prosecutor. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 4. The record would show that the matter is coming up for cross- examination of P.W20, who is investigating officer and the matter is directed to be posted before the Trial Court. It is also represented across the bench that the investigating officer is working now in the Patamata. The impugned order would show that the Special Public Prosecutor will be available from 19.02.2026. 5. Having regard to the circumstances of the case, in view of the fact that the Special Public Prosecutor will be available from 19.02.2026, and considering that the Sessions Case pertains to the year 2013, it is apposite to dispose of the present Criminal Revision Case with a direction to the Trial Court to take up S.C. No.55 of 2013 on 19.02.2026 and proceed with the cross-examination of P.W.20. The Investigating Officer (P.W.20) is also directed to appear before the Trial Court on 19.02.2026 and cooperate with the proceedings to cross-examination. 6.
