This is the First bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.129/2025 registered at Police Station-Civil Line, District - Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of BNS, 2023. 2. The case of the prosecution, in a nutshell, is that information was received through the Cyber Crime Reporting Portal that certain bank ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.02.19 18:15:36 +0530
2 accounts had been fraudulently opened in Finance Bank, Civil Lines Branch, Raipur, and were being used for receiving the proceeds of cyber fraud. It is alleged that the accused persons embezzled an amount of Rs. 54,10,855/-. Acting on directions from the Police Headquarters, a report regarding the said incident was forwarded to Police Station Civil Lines, Raipur, where an FIR was registered against certain account holders, including the present applicant, for the commission of the aforesaid offences punishable under Sections 317(2), 317(4), 317(5), 111 and 3(5) of the B.N.S
3. The learned counsel for the applicant submits that the present applicant is an innocent person and has ben falsely implicated in the present case. She submits that the entire allegations made against the applicant are false and fabricated, as the applicant has neither received nor transferred any fraudulent amount in his account, nor has he played any role in connection with the alleged crime. She further submits that merely on the basis of suspicion, the present applicant has been falsely implicated in connection with this crime without any sufÏcient reason and without any material available on record. There is no documentary evidence to prove the case, and the prosecution has not produced any documents regarding the subject amount or the transactions pertaining thereto. She further submits that there is no evidence to show that the accused received or misappropriated the said subject amount. She submits that the applicant has been in jail since 11.04.2025, conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the applicant. 4.
On the other hand, learned State counsel submits that, as per the prosecution case, information was received through the Cyber Crime Reporting Portal regarding the fraudulent opening of bank accounts in
3 Finance Bank, Civil Lines Branch, Raipur, which were used to receive proceeds of cyber fraud. It is alleged that the accused persons, including the present applicant, embezzled an amount of Rs. 54,10,855/- through such fraudulent transactions. She also submits that the similar situated co-accused bail application have also been rejected by this Court in MCRC No. 5298 of 2025 and MCRC No. 5342 of 2025, MCRC No. 1416 of 2026 and MCRC No. 1533 of 2026 vide orders dated 09.07.2025 and 10.02.2026, 12.02.2026 respectively, therefore, the applicant is not entitled to the grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the fact and circumstances of the case,
submissions made by learned counsel for the parties, allegation levelled against the present applicant, involvement of organized serious cyber crime offence, bail application filed by the co-accused persons have already been rejected by this Court in MCRC No. 5298 of 2025 and MCRC No.5342 of 2025, MCRC No. 1416 of 2026, MCRC No. 1533 of 2026 vide orders dated 09.07.2025, 10.02.2026 and 12.02.2026 and the case of the applicant is identical to that to the aforementioned co- accused persons, as such without expressing any opinion on the merits of the case, this Court is of the view that it is not a fit case to release the applicant on bail.

Accordingly, the first bail application of the applicant – Ravi Panjwani, filed under Section 483 of the BNSS, involved in Crime No.129/2025 registered at Police Station-Civil Line, District - Raipur (C.G.), for the offence punishable under Sections 317(2), 317(4), 317(5), 111, 3(5) of BNS, 2023, is rejected.
8. Needless to say that the trial Court concerned, is at liberty to proceed
4 and conclude the trial expeditiously.
