JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.1 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in SC No.12/2022 arising out of Crime No.9/2019 of Chintamani Town Police Station pending on the file of the learned II Additional District and Sessions Court, Chikkupalapura sitting in Chintamani registered for the offences punishable under Sections 201, 302, 307, 328 and 120B of IPC. 2. The petitioner earlier had been granted bail by order dated 05.07.2019. Thereafter, he appeared in SC No.128/2019 on some dates. Thereafter, he remained - 3 - HC-KAR NC: 2026:KHC:12248 CRL.P No. 17055 of 2025 absent. The case against him has been split up by order dated 20.4.2022 and registered in SC No.12/2022. The petitioner could not appear in the split-up case and NBW has been issued against him, and he has been secured on 06.12.2024 by executing NBW, and since then he is in judicial custody. It is submitted that the petitioner was working in Bhadravathi, and due to COVID-19, he could not appear before the Trial Court, and he lost communication with his counsel. 3. The petitioner has now deposited Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/- before the Trial Court in SC No.12/2022 on 27.02.2026. The said amount deposited by the petitioner requires to be appropriate to the State towards forfeited bond amount. The petitioner has undertaken to appear before the Trial Court on all dates of hearing and abide by any conditions to be imposed by this Court. - 4 - HC-KAR NC: 2026:KHC:12248 CRL.P No. 17055 of 2025 4. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions: In the result, the following: ORDER: i) The petition is allowed ii) The petitioner is granted bail in SC No.12/2022 arising out of Crime No.9/2019 of Chintamani Town Police Station pending on the file of the learned II Additional District and Sessions Court, Chikkupalapura sitting in Chintamani registered for the offences punishable under Sections 201, 302, 307, 328 and 120B of Bharatiya Nayay Sanhita, 2023 subject to following conditions: a) The petitioner shall execute bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Trial Court. b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. - 5 - HC-KAR NC: 2026:KHC:12248 CRL.P No. 17055 of 2025 c) The petitioner shall attend the Trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case.
