1. Since the legal issue involved in both these petitions is similar and parties are slightly different, as requested by both sides, these matters are taken up together.
2. Broadly speaking, it appears that the learned Magistrate allowed the application of the present petitioner under Section 175(3) BNSS and
directed registration of FIR against the present respondents. Thereafter, the present respondents filed revision petitions, in which by way of ex-parte
order impugned in the present petitions, the learned Principal District & Sessions Judge concerned, stayed operation of the order passed under Section 175(3) BNSS.
3. Learned Senior Counsel for petitioner contends that the impugned orders are not sustainable in the eyes of law, because the same are completely bereft of any reason. In response, learned counsel for respondents submit that the impugned orders are only interlocutory orders, operatable only till next date and that the learned Court of Sessions is yet to hear the complete revision petitions.
4. Under these circumstances, learned Senior Counsel for petitioner, on instructions, seeks permission to withdraw these petitions with the request to direct the learned Court of Sessions to dispose of the said revision petitions within time bound period.
5. As requested, both these petitions and the accompanying applications This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 05/09/2026 at 09:57:15
are dismissed as withdrawn. The learned Court of Sessions is requested to ensure that both the revision petitions are completely disposed of after hearing both sides within a period of four weeks from 28.09.2026, which is the date already fixed for appearance of both sides. In order to ensure no delay, learned counsel for respondents assures to supply complete set of revision paperbooks to learned counsel for present petitioner during the course of the day. It is also directed that neither side shall seek any adjournment before the learned Court of Sessions.
6. For compliance, copy of this order be sent to the learned Principal District & Sessions Judge concerned.
