Learned counsel for the petitioners submits that as per the terms of compromise, the defendants 1 and 2, if they are willing to sell the property, ought to have informed the other sharers by giving prior notice, but, without exercising such option, they have straight away sold the property to the third defendant and also made an attempt to make allegations subsequent to the terms of compromise and came forward with a suit and filed an application in I.A.No.3 of 2026 praying for temporary injunction. The trial court, without passing any order, simply issued notice to the respondents. 3. As on date, I.A.No.3 of 2025 is pending before the trial Court.
