Inter alia contends that the present respondent had overstayed parole for 3 years, 04 months and 16 days and resultantly had been convicted for period of one year simple imprisonment, in view of the provisions of Section 9 of the Himachal Pradesh Good Conduct Prisoners (Temporary Release) Act, 1968. It is, thus, submitted that the provision as such provides an explanation that the punishment in this section is in addition to the punishment awarded to the prisoner for the offence for which he was convicted.
Learned Single Judge has relied upon the provisions of Section 427 of the Cr.P.C. sub-Clause 2 where a lifer as such would get a benefit for being sentenced on a subsequent conviction to run concurrently with the previous sentence. It is submitted
that the purpose of 1968 Act is to provide for a deterrent as such and the purpose as such would be frustrated if the view taken by the learned Single Judge is applied, wherein the lifer as such a convict undergoing life imprisonment would be immune to any such punishment.
The present appeal requires consideration.
