This petition has been filed for initiation of a contempt proceeding for alleged violation of the order dated 06.02.2024 passed by this Court in W.P.(S) No. 6150 of 2023. 3. The learned counsel for the opposite party has submitted that Rs.10,00,000/- and other amount has already been paid. So far as payment of CMPF amount is concerned, there is some dispute regarding the number of children. He submits that as per service record, there are 3 children, and as of now, the petitioner is coming up with only 2 children. 4. The learned counsel has submitted that the decision has to be taken by the CMPFO and not by the opposite parties and CMPFO was not a party in the writ petition. 5. To this, the learned counsel for the petitioner submits that the opposite party ought to have forwarded the records to CMPFO for necessary orders and if the identity of the mother is not in dispute, there can be no dispute regarding identity of the children. Otherwise 2026:JHHC:18023 2 also, the appropriate documents showing the identity can always be produced particularly reflecting the name of the father of the children. 6. Considering the aforesaid facts and circumstances and the nature of the order passed by this Court, this Court is not inclined to proceed any further in this contempt proceeding. 7. However, the appropriate party is required to forward the service book and necessary details to CMPFO, who according to both the parties, is the competent authority to pass an order with regard to claim of CMPF. 8. It will certainly be open to the petitioner to approach the competent authority under CMPFO for redressal of their grievance and opposite party shall cooperate in the matter and also forward the connected records.
