Order 15/01/2026
1. Petitioner has challenged orders dated 05.07.2002 & 11.09.2002 passed by Assistant Inspector General and Deputy Commandant, CISF respectively for effecting recovery of Rs.12,076/- in 24 equal installments.
2.
Learned counsel for the petitioner submits that such recovery was being effected against the petitioner without following the due procedure and affording opportunity of hearing to the petitioner, whereas the recovery sought to be made is
[2026:RJ-JP:1577] (2 of 2) [CW-6811/2002] stigmatic as allegation with regard to mishandling the vehicle was imposed upon the petitioner, who was serving as driver.
3. Thereupon, learned counsel for the respondents has drawn attention of this Court towards Annexure-R/1 dated 09.04.2001, which gives reference of Court of Enquiry in respect of vehicle No. JK-14-1526 as well as order of appeal dated 03.09.2002 (Annexure-R/2) submitted along with reply and he opposed the writ petition by stating that correct facts have not been placed on record. Order impugned has been passed after giving due opportunity to the petitioner and after conducting Court of Enquiry and even against the order of penalty, appeal was filed by the petitioner, which was also decided by the Appellate Authority after taking into account all the facts, material on record and the grounds raised in the appeal.
4. Heard learned counsel for the parties and perused the record.
5. In view of the above, where penalty of Rs.12,076/- have been imposed upon the petitioner after following the due procedure and conducting the Court of Enquiry and even the appeal filed by the petitioner has been dismissed, learned counsel for the petitioner has utterly failed to point out any irregularity, illegality or perversity in the proceedings against him. Hence, writ petition filed by the petitioner, is hereby, dismissed being devoid of any substance and merit.
6. Pending application(s), if any, stand disposed of.
