This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a Writ of Mandamus or any other appropriate writ, order, or direction declaring the inaction of the respondents in not releasing the retirement benefits i.e., Gratuity, Encashment of Earned Leave Half Pay Leave, Surrender Leave, ZP Provident Fund, and PRC arrears to the petitioners in spite of their retirement as illegal, arbitrary, and unconstitutional, and consequently direct the respondents to release the retirement benefits i.e., Gratuity, Encashment of Earned Leave Half Pay Leave, Surrender Leave, ZP Provident Fund, and PRC arrears to the petitioners along with 9percent interest on the delayed retiremental benefits in terms of law laid down by the Honble Apex Court reported in (2022) 4 SCC 627 and W. A. No. 383 of 2022 dated 12. 07.2022 to the petitioners from the date of entitlement till the date of payment, and pass…” 2. Heard the learned counsel for the petitioners and the learned Government Pleader for Finance Department appearing for the respondent Nos. 1 to 10. 3. Learned counsel for the petitioners submits that the respondents have not released the retirement benefits, namely, Gratuity, Encashment of Earned Leave, Half Pay Leave, Surrender Leave, ZP Provident Fund, and PRC arrears, to the petitioners despite their retirement. 4. The learned Government Pleader submits that, upon quantification of the retirement benefits of the petitioners, the same will be released subject to clearance by the Finance Department. 5. Considering the submissions made by the learned counsel for the petitioners and the learned Government Pleader, and upon perusal of the material available on record, this Court is of the considered view that the writ petition can be disposed of with a direction to the respondent authorities to process and pay the retirement benefits to the accounts of the petitioners within a period of six (06) weeks from the date of receipt of a copy of this order. 6. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
