This is the Second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who have been arrested in connection with Crime No.192/2025, registered at Police Station – Civil Line, Raipur, District- Raipur (C.G.) for the offence punishable under Sections 420, 467, 468 and 471 of Indian Penal Code. 2. Earlier bail application of the applicant was rejected on merits by this Court vide order dated 21.08.2025 passed in MCRC No. 6593/2025. 3. 2 issued a forged appointment letter. Based on the complaint, the concerned police registered a crime against the present applicant for offences punishable under Sections 420, 467, 468, and 471 of the Indian Penal Code. Hence, this bail application is being filed before this Court. 4. It is respectfully submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the first bail application of the applicant was rejected on merits by this Court vide order dated 21.08.2025 passed in MCRC No. 6593/2025. This is the second bail application filed on behalf of the present applicant on the ground that, out of 22 witnesses, 06 witnesses have been examined, and 05 prosecution witnesses have turned hostile, and a compromise has been arrived at between the parties. It is further submitted that the applicant has no previous criminal antecedents and the charge sheet has already been filed. The applicant has been in jail since 04.05.2025.
As the trial is likely to take a considerable time for its conclusion, the applicant prays that he be released on bail. 5. On the other hand, the learned counsel for the State opposes the bail application and submits that the first bail application of the applicant was rejected by this Court on the ground that the applicant took money from the complainants on the pretext of providing government jobs and issued forged appointment letters. It is also submitted that the applicant used the official seal of a Minister, along with other forged documents such as transfer and promotion orders, as is evident from the case diary. Therefore, the present bail application is liable to be rejected. 6. I have heard learned counsel for the parties and perused the documents available on record. 7. Considering the facts and circumstances of the case, the nature and
3 gravity of the allegations made against the applicant, and the fact that this is the second bail application filed by the applicant, although the first bail application was dismissed by this Court on merits vide order dated 21.08.2025 passed in MCRC No. 6593/2025, a new ground has now arisen that the applicant has been in judicial custody since 04.05.2025, further out of 22 witnesses, 06 witnesses have been examined, and 05 prosecution witnesses have turned hostile, and a compromise has been arrived at between the parties, but considering the serious nature of the allegations involving forgery of official documents, including appointment letters, transfer orders, promotional letters, and misuse of a Minister’s seal, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 8. Accordingly, the second bail application of the applicant - Gagandeep @ Gagan Arora involved in Crime No.192/2025, registered at Police Station – Civil Line, Raipur, District- Raipur (C.G.) for the offence punishable under Sections 420, 467, 468 and 471 of Indian Penal Code, is rejected at this stage. 9.
