Learned counsel for petitioner would submit that petitioner is holding the post of Panchayat Secretary and he is victim of frequent transfer. Petitioner was transferred by respondent No.1 vide order dated 16.12.2024 from Janpad Panchcyat Simga to Village- Panchayat Semariya, Janpad Panchayat Kasdol. Just after completion of one year, petitioner is again transferred from Village Panchayat Semariya to Village Panchayat, Kharra (B) vide order dated 29.01.2026 (Annexure P-1) and within a further period of two days, again amended order (Annexure P-5) dated 02.02.2026 has been passed, whereby petitioner has been shown to be transferred from Village Pancyhayat Semariya to Ammakhoha. He submits that all this exercise is done only to accommodate one Smt. Ramsnehi Sahu, therefore, the impugned order be interdicted.

Order of transfer is passed by respondent No.1/Zila Panchayat, Balodabazar – Bhatapara. Under the Chhattisgarh Panchayat (Appeal and Revision) Rules, 1995 (In short ‘the Rules, 1995’), appeal and revision is provided against the order passed by the Zila Panchayat, before the Director, Panchayat under Rule 3 of the Rules, 1995.

Perusal of the impugned transfer order (Annexure P-5) would show that it is an amended order passed by Zila Panchayat, Balodabazar- Bhatapara amending the transfer order dated 29.01.2026 (Annexure P-1). The order of transfer is passed by Chief Executive Officer, Zila Panchayat, Balodabazar - Bhatapara and under the Rules, 1995, the
order passed by the Zila Panchayat is appealable, before the Director of Panchayat.

5. In the aforementioned facts of the case, I find it appropriate to dispose of this writ petition at this stage permitting petitioner to submit an appeal before the Director, Panchayat as provided under Rule -3 of the Rules, 1995.
6. At this stage, learned counsel for petitioner submits that petitioner is still holding the charge of Panchayat Secretary of Village Panchayat, Semariya, therefore, he may be granted interim protection, till filing of appeal and consideration on the application for grant of interim relief.

On due consideration on the submission of learned counsel for petitioner as also the facts and circumstances and order enclosed along with writ petition, purely as an interim measure it is directed that in the event petitioner submits an appeal within period of 15 days from today, concerned authority shall consider and take decision on the application for grant of interim relief within further period of three weeks from the date of receipt of appeal.
8. Till decision is taken on the application for grant of interim relief, status-quo as it exists today with respect to place of posting of petitioner shall be maintained by the parties.
